Please read these “KEREN OR FOR OUR CHILD” Website Terms of Use (hereinafter referred to as “the Terms”) carefully before using the websites of Charitable Foundation “KEREN OR FOR OUR CHILD” or making charitable contributions to the Foundation online through such websites (hereinafter – “the Website”). These Terms contain important information about your rights and obligations.

By using the Website, where these Terms are posted, you confirm that you have read the Terms, understand their content, and agree to fully comply herewith. If you disagree with these Terms, please do not use this Website.

The terms “KEREN OR FOR OUR CHILD”, “KEREN OR FOR CHILD”, “the Foundation”, “we”, “us” or “our” used in these Terms mean the Charitable Foundation “KEREN OR FOR OUR CHILD” – a non-profit organization (EDRPOU code 44393299, address: 66a Hetman Mazepa Str., Ivano-Frankivsk, Ukraine), which carries out charitable activities by means of the Website.

Collection and use of personal data related to your use of the Website shall be carried out according to our Privacy Policy.

Entire agreement

Short version: These Terms are an agreement between us and our users. By using this Website, you agree to comply with these terms and all applicable laws and regulations. You must be a legally capable person. These Terms and any rules posted on the Website, including our Privacy Policy, constitute a legally binding entire agreement between you (“you” or “the user”) and “KEREN OR FOR OUR CHILD”, which regulates your use of the Website and gathering of charitable contributions by means of the Website.
By using the Website, you thereby declare and confirm that:
in accordance with the legislation of your country you are legally capable and competent to enter into this agreement;
the legislation of your country does not restrict your use of the Website;
you comply with these Terms and relevant legal requirements.

Short version: The Website of “KEREN OR FOR OUR CHILD” is intended for the users, who want to make a charitable contribution or otherwise help the Foundation, as well as parents/guardians of cancer-stricken children that need help.

Since 2021 every day the Charitable Foundation “KEREN OR FOR OUR CHILD” has been helping Ukrainian families beat cancer, and doctors – save the lives of cancer-stricken children. The founders of the Foundation are Kyzymyshyn Mykhailo Yosypovych and Bandar Halyna Yosypivna. The Foundation is not owned by any of the political parties, commercial organizations or persons of influence and it is funded through charitable contributions from individuals and legal entities. All documents of the Foundation are
available on our Website in the “Reports and documents” section.

The Websites of “KEREN OR FOR OUR CHILD” serve as a tool for carrying out charitable activities in the following areas:
– Help for children
– Help for hospitals
– Training for doctors
– Children’s rights

The Website is intended for the users, who want to make a charitable contribution (“Donators”) or otherwise help the Foundation (“Volunteers”), as well as parents/guardians of cancer-stricken children that need help (“Beneficiaries”).

I want to help

Short version: You can make one-time and monthly charitable payments to the Foundation by means of the Website. The funds received by the Foundation will turn into help for children. You can view financial and tax reports related to the use of funds on the Website.

By means of the Website users can make charitable contributions in favor of the Foundation that applies them in the abovementioned areas. You can make a one-time donation or activate a subscription for a monthly payment of certain amount, which can be canceled at any time using the settings of your Personal account or by filling out the form.

Users can also make charitable contributions in the form of gifts to children by transferring funds for the things we offer. The full list of such gifts can be found at the link.

The Foundation does not conduct targeted fundraising, instead of that it purchases medicines for certain children at the request of parents/guardians or for the department, with which the memorandum of cooperation was signed, at the request of the head of such department. The funds raised by the Foundation are used to purchase medicines, consumables, laboratory reagents, to pay for examinations conducted outside the territory of Ukraine, as well as for psychological, palliative, and other care for the cancer-stricken children and their families.

The Foundation prepares the reports on the use of charitable contributions monthly until the end of the next reporting month and publishes them at the link. Moreover, the Foundation annually submits a report on the income (profit) use of a non-profit organization to the tax inspectorate. Such reports are also available on our Website.

Please note that payments through our Website are ensured by payment service providers that we do not control, i.e.: LiqPay, Portmone, PayPal, Kuna. Once you click the payment link, you must comply with the terms of use, privacy policies, and other policies of such providers. Under no circumstances the Foundation shall be responsible for payment details processed by such providers.

You can also make a charitable contribution using the websites of our partners Keren Or for Child Israel. All funds raised by our partners are transferred to the Foundation’s current account or used on behalf of the Foundation to pay for the services of foreign medical institutions provided to beneficiaries of the Foundation.

Please note that we do not control the exchange rate and commission fee that may be applied by the bank.

Need help

Short version: Parents/guardians of children under 18 years of age, who need help fighting cancer, can apply for aid from the Foundation.

Please note that the Foundation provides aid only to the citizens of Ukraine under 18 years of age as of the date of application with oncological, oncohematological, hematological and, in certain cases, immunological diseases (the Foundation can help the patients, who are 18 but under 19 years of age, only in special cases).

To request the Foundation for help, please fill out the form at the link. The application form contains mandatory information, in particular, an extract with the exact diagnosis of patient, the patient’s age and name, etc. Information about processing of the personal data provided and your rights in this regard can be found in our Privacy Policy.

The application form will be processed by the Foundation’s employees within 5 business days. You agree that, if necessary, an employee of the Foundation can contact you for further details.

If the Foundation approves your application form, you will need to write an application for being taken into care, as well as, if necessary, enter into a charitable activity agreement with the Foundation.

The Foundation does not guarantee that you will receive the necessary aid in full and within a prescribed period, as this depends on the charitable contributions provided by Donators and the queue of Beneficiaries applying for aid.

Volunteers

Short version: If you want to help cancer-stricken children using your knowledge, skills or time, you can become a volunteer at the Foundation.

We invite you to help children not only with funds, but also by volunteering. Nowadays, more than 100 unchanging volunteers help children: actors, photographers, designers, lawyers, translators, hairdressers, as well as many other people of various professions.

To become a volunteer of the Foundation or a hospital volunteer, please fill out the application form at the link. Our coordinator will contact you using the specified contact details and tell you how and when you can help the Foundation with charitable activities. In the first instance, the Foundation’s employees will provide you with an introductory briefing and, if necessary, additional training.

At your request, the Foundation will enter into an appropriate agreement for volunteer activities.

If you are under 18 years of age, you can also become a volunteer of the Foundation. To do this, your parents/ official guardians shall provide us with written consent to your volunteer activities in favor of the Foundation.

Personal account

Short version: When creating a Personal account, you must provide a valid email address. You are responsible for your Personal account and consequences of its use, as well as for its security.

You can create a personalized account (“Personal account”) at the time of making a charitable payment at the link or on other websites of the Foundation. In your personal account, you can terminate your monthly payment subscription at any time, view your payment history and payment status.

All the information you provide will be saved for your identification when you log in to the Personal account.

You must provide accurate, up-to-date and complete information during registration and keep your Personal account information up-to-date at all times. You can learn more about the rules for processing personal data in our Privacy Policy.

You may not transfer or share your Personal account with other persons. You are responsible for maintaining the confidentiality of your Personal account login data as well as for all actions performed with the use of your Personal account.

You are responsible for ensuring that your use of the Website and Personal account does not contradict applicable laws, rules or other statutory regulations.

If you know or suspect for any reason that someone has gained access to your Personal account, or your login details have been lost, stolen, misappropriated, or your Personal account has been hacked in any manner whatsoever, please let us know immediately by email at service@kerenor4child.org.ua.

Third-party services and websites

Short version: When using websites and services that we do not control, you must comply with other terms of use and privacy policies.

Some functions of the Website, such as making a charitable payment, involve the use of third-party services and websites that are not controlled by “KEREN OR FOR OUR CHILD”.
If any problems arise, we will make every effort to solve them. However, we are not responsible for the content and functionality that may be offered on such websites or by such third-party services, as well as for any loss, damage or other monetary obligations resulting from your use of such third-party websites or services.

Please note: other terms of use and privacy policies apply to your use of third-party websites and services.
Under no circumstances Tabletochki shall be responsible for personal data processed by the third-party websites and services.

Content and intellectual property

Short version: The Foundation owns the Website and all its content. We grant you certain rights to use the Website and content to the extent stipulated in these Terms.

The Website is owned and controlled by the Foundation. All materials of the Website, including texts, images, design, graphics, information, logos, audio and video recordings, interfaces, software, trademarks, trade names and other (“Content”), as well as copyright and other intellectual property rights to such Content belong to the Foundation or are posted with the consent of the owner.

The Content or any of its elements may not be used without a prior written permission of the Foundation or the respective owners in any way not provided for in these Terms.

Subject to your compliance with these Terms, the Foundation grants you a limited, non-exclusive, revocable license, without the right to sublicense or transfer, to:

use the Website from your personal devices under the terms provided for herein;
and
2. access and view any Content posted on or through the Website solely for personal, non-commercial use.

As a result of downloading or creating copies of the Content, you do not receive any rights to such content. You may not reproduce, publish, transmit, distribute, modify, create derivative works or otherwise use the Content for commercial or illegal purposes without our prior written permission. You agree not to change or remove any ownership notices from the materials downloaded or printed from the Website.

The Foundation may change the terms or revoke this license or terminate your access to the Content at any time and for any reason without prior notice. Disclaimer of warranties and limitation of liability

The Foundation is responsible for the use of charitable contributions in accordance with the current legislation of Ukraine.

However, we do not make any promises or guarantees, in particular regarding the accuracy, usefulness, reliability and correctness of the Website. “KEREN OR FOR OUR CHILD” does not guarantee that the Website will operate continuously or safely, that any defects will be corrected, or that the Website is free of viruses or other malicious elements.

The Foundation is not responsible for inaccurateness or incompleteness of any information, materials or content available on the Website, as well as for typographical errors or shortcomings in the text or other materials.

Under no circumstances the Foundation, its founders, employees, contractors or volunteers shall be liable for direct, indirect, accidental, special, awarded and incidental damages related to the use of or inability to use the Website, including, but not limited to, any losses that have arisen as a result of errors, omissions and interruptions in operation, defects, viruses, even if the Foundation has been notified of the possibility of such losses.

The above provisions regarding the disclaimer of warranties and limitation of liability shall apply to the maximum extent permitted by applicable law.

Compensation for damages

Short version: You are responsible for using the Website. If you inflict harm to someone else or get into a dispute, we will not participate in resolution thereof.

Within the maximum limits permitted by the current legislation, you agree to indemnify from liability, compensate for losses and protect “KEREN OR FOR OUR CHILD”, our partners, employees, contractors and volunteers from any claims, liability, damages, losses and expenses, including reasonable legal and accounting expenses, in any way related to or arising from: (i) your violation of any of these Terms, (ii) your use/ improper use of the Website, content, features available thereon, or (iii) your violation of laws or third party rights.

You also agree to reimburse the Foundation for any losses and expenses incurred by it (including fees or expenses for lawyers, accountants, professional consultants, and other experts) in connection with the defense or settlement of disputes arising from your use of the Website for any illegal or prohibited purposes.

We reserve the right to choose the legal remedies that we deem appropriate, including cases, in which you release us from liability. Therefore, you agree to cooperate with us in implementing our strategy to protect our rights.

Applicable law and dispute resolution

Short version: This agreement is regulated by the legislation of Ukraine. We hope to resolve all issues peacefully, but if a serious dispute arises between us, it should be resolved in the courts of Ukraine.

Except as may be otherwise provided in these Terms or any other policies, these Terms are prepared and interpreted in accordance with the legislation of Ukraine. If any material on the Website or your use of the Website contradicts the laws of your location, the Website is not intended for you, and we ask you not to use it. You are responsible for familiarizing yourself and complying with the laws of your jurisdiction. Any dispute, conflict, claim or argument directly or indirectly related to the Website or these Terms, i.e., their validity, interpretation or application, shall be resolved through peaceful negotiations directly with the team of the Charitable Foundation “KEREN OR FOR OUR CHILD” following the principles of good faith and cooperation.

If a consensus cannot be reached through negotiations, the dispute shall be resolved exclusively in the courts of Ukraine following the rules of jurisdiction in accordance with the current substantive law of Ukraine.

All claims shall be submitted within one (1) year of their occurrence, except where the applicable law requires a longer period.

Electronic communications

By providing us with your email address through the Website, you understand and agree that we may send you notifications to the contact details you provide, i.e., (i) notifications about updates on the Website; (ii) information or materials related to your use of the Website, making charitable contributions and their use; (iii) information about update of these Terms.

You can opt out of receiving emails from us by following the instructions provided in such notifications.

Miscellaneous

If any of the provisions of these Terms is declared illegal, invalid or inapplicable, the remaining provisions hereof will remain in effect and will be enforceable.

We may delegate our rights and obligations under these Terms to the third party, but this will not affect your rights or our obligations under this agreement.

The printed version of these Terms shall be admissible evidence in court or administrative proceedings arising based on or in connection with the use of the Website to the same extent and under the same conditions as other business documents and records created and stored in hard copy.

We reserve the right to make changes to these Terms at any time. In case of a significant change that may affect your use of the Website or your rights as a user of the Website, we will notify you of such changes within a reasonable time prior to their entry into force by posting a corresponding notification on the Website or sending you an email.
